GREAT BAY--Minister of Public Housing, Spatial Planning, Environment and Infrastructure Patrice Gumbs says Government is carefully reviewing the full Mullet Bay judgment, with particular attention being given to legally guaranteed public access to the beach and clarification of the boundaries between the public beach and surrounding land.
“I want to be transparent with you about what comes next,” the Minister said. “The judgment addresses a number of related matters, and my Government, together with legal advisors, is carefully reviewing the full decision to determine the appropriate way forward.”
Gumbs said the implications of the ruling for access to Mullet Bay Beach form part of that review.
“In particular, we are working through the details around this ruling, including ensuring that access to the beach is guaranteed by law and clarifying where the boundaries lie,” Gumbs said.
The Minister stressed that Government intends to approach the next phase carefully and responsibly.
“This work is important and we intend to get it right,” he said.
Gumbs' comments follow the Court ruling confirming Government's historical and legal position that Mullet Bay Beach itself remains public property and was never acquired by Sun Resorts N.V.
“Mullet Bay Beach has always been and remains public property, belonging to you, the people of St. Maarten,” Gumbs said.
The judgment arose from proceedings brought by Sun Resorts against the Country of St. Maarten and addressed a longstanding dispute over ownership of one of the island's most significant natural and public assets.
According to Gumbs, the Court accepted Government's position and confirmed that Sun Resorts never acquired ownership of the beach itself.
“This is an important victory for St. Maarten,” he said. “This ruling gives us long-term legal certainty over the beach and ensures that this asset remains for generations to come.”
The Minister reassured the public that Government will continue acting in the country's interest as the legal and practical implications of the judgment are examined.
“I want to reassure everyone that I remain fully committed to acting in the best interest of St. Maarten. As this process continues, we will keep you informed,” Gumbs said.
