PHILIPSBURG:— The Court of First Instance in its decision on Wednesday ordered the Holding Company of PJIAH to reinstate its Chief Executive Officer Brian Mingo as of immediately. The court ruled that Princess Juliana Holding Company did not follow proper procedures when they terminated Mingo on April 7th, 2021. Mingo filed a court injunction which was heard on Monday, May 10th, 2021.
While the decision rendered on Wednesday is in favor of Mingo the legal battle between his employer PJIAH and him is far from over since the lawyer for the Airport already indicated that they will be seeking the approval of the court to dismiss him since their working relationship is not repairable.
The decision which is attached to this article reads as follows:-
5.1. suspends with immediate effect (i) the termination decision of 7 April 2021 and (ii) the suspension decision of 7 April 2021 of the Operating Company³ such that these decisions have no legal effect;
5.2 Does (i) the Holding Company and (ii) the Operating Company, as of today, authorize Mingo to resume and continue its management duties as chairman of the Operating Company under the Service Agreement between it and the Operating Company, until a judge decides otherwise, under penalty of a penalty to be forfeited of US $ 20,000.00, each, for each day, including a half-day, that the Holding and/or the Operating Company does not comply with the order given to it up to a maximum of US $ 500,000.00 each, which penalties will then be forfeited two days after the notification of this judgment;
5.3 orders the Holding to pay the legal costs estimated on the part of Mingo at NAF 2,500.00 and compensates the legal costs for the remainder;

5.4. declares the judgment provisionally enforceable so far;
